Evolución y actualidad del derecho del consumidor en Argentina y el Mercosur

Abstract

En el presente trabajo analizaremos la evolución del Derecho del Consumidor y su estado actual en la Argentina y en el Mercosur, pues entendemos que la tutela de este derecho fundamental, ya sea en el ámbito del Mercosur o en los ordenamientos jurídicos nacionales de los miembros plenos1, no muestra el avance que se hubiera requerido en la actualidad. La postergada aprobación del proyecto de Protocolo de Defensa del Consumidor del Mercosur, y la insuficiente legislación existente en la materia en algunos Estados en la región, da cuenta de ello. Consecuentemente, el mecanismo de producción, distribución y consumo desarrollado por esta sociedad consumista, propicia el terreno para que se concreten relaciones de consumo, muchas veces, signadas por cierto grado de injusticia e inseguridad jurídica.

In this paper we analyze the evolution of consumer law and its current status in Argentina and Mercosur, as we understand that the protection of this fundamental right, whether in the context of Mercosur or national legal full members, does not show the progress that has been required at present. The delayed adoption of the draft Consumer Protection Protocol of Mercosur, and insufficient existing legislation on the subject in any in the region, realize it. Consequently, the mechanism of production, distribution and consumption developed by this consumerist society, leads the way for consumer relations materialize, often marked by a degree of injustice and legal uncertainty.
