Abstract: | La violencia familiar es un fenómeno problemático para al abogado al momento de diseñar estrategias legales. Esta situación se ve acrecentada por ambigüedades, tanto en el campo específicamente jurídico como en el social. A esto se agregan las distintas posiciones que puede asumir el mismo profesional. En el núcleo de todo esto se encuentra instalada una tensión entre lo público y lo privado. El trabajo sugiere que, para lograr diseñar mejores estrategias jurídicas, es necesario llegar a lograr clarificar conceptos. Con este fin, propone un enfoque multifacético jurídico, correlacionado con la realidad social, o sea no solo pensar políticas transversales sino también plantear la transversalidad en la práctica legal. Lawyers tend to find serious difficulties when trying to choose the correct legal strategy for cases of family violence. Practitioners approach this topic from several theoretical stands. Theoretical frames have a decisive influence in the chosen legal strategy. However, there are other reasons for the high level of negative outcomes. One cause might be deficient legal provisions. Another, the ambiguity lying behind legal concepts. This void has encouraged highly discretionary practices in the justice system. Behind all this lies something unsolved, the clear limits between public and private realms and the relationship between family, state and society. Family life has been traditionally legally protected from external irruptions On the other hand, family life is the everyday occurrence of violence and maltreatment. In order to overcome present legal tensions it is necessary to change the legal angle of analysis. Therefore, practitioners should include in the everyday case not only the traditional perspectives of civil and criminal law and interdisciplinary notions, but also a broader legal approach, in order to include public and international law principles. |
