Abstract: La reforma del Código Civil y Comercial de la Nación vino a dar luz a un nuevo instituto en el artículo 248, planteando así a la subrogación real en el régimen de vivienda, la cual no estaba contemplada en la derogada Ley 14.394. La entrada en vigencia del nuevo Código trajo como consecuencia que los Registros de la Propiedad de las diferentes jurisdicciones dictaran nueva normativa registral conforme a la reciente disposición nacional. El objeto de este trabajo es demostrar la afectación del sistema de publicidad registral como consecuencia de los diferentes criterios adoptados por los registros inmobiliarios. De esta manera se obtiene que la cognoscibilidad respecto de las situaciones jurídicas existentes se ve dificultada en algunos casos y en otros es inexistente vulnerando de esta forma el derecho de los terceros interesados.
The reform of the Civil and Commercial Code of the Nation begins a new institute in article 248, thus posing the real subrogation in the housing regime, which was not contemplated in the repealed Law 14.394. The entry into force of the new Code brought as a consequence that the Property Registries of the different jurisdictions issued new registry regulations in accordance with the recent national provision. The purpose of this work is to demonstrate the impact of the registry advertising system as a consequence of the different criteria adopted by real estate registries. In this way it is obtained that the knowability, with respect to the existing legal situations, is hindered in some cases, and in others it is non-existent, thus violating the right of interested third parties.

A reforma do Código Civil e Comercial da Nação deu origem a um novo instituto no artigo 248, elevando assim a real sub-rogação no regime habitacional, o que não estava previsto na revogada Lei 14.394. A entrada em vigor do novo Código trouxe como consequência que os Registros de Imóveis das diferentes jurisdições emitiram novos regulamentos de registro de acordo com a recente disposição nacional. O objetivo deste trabalho é demonstrar o impacto do sistema de publicidade cadastral em decorrência dos diferentes critérios adotados pelos cartórios de imóveis. Desta forma, obtém-se que a cognoscibilidade, no que diz respeito às situações jurídicas existentes, é dificultada em alguns casos, e noutros é inexistente, violando assim o direito de terceiros interessados.
