Las implicancias del derecho y la ética respecto del embrión, en especial referencia a los derechos reales

Abstract

El presente trabajo tiene por objeto efectuar un análisis de distintas perspectivas que importen llegar a la elaboración de un correcto enfoque respecto al objeto de los derechos reales. A esos efectos el estudio se ceñirá al tratamiento de un tema sensible, como lo es el embrión humano. En ese orden de ideas intentaremos determinar si el embrión humano puede o no ser objeto de los derechos reales. A esos efectos se analizará su significado, sus implicancias sociales, éticas, jurídicas y morales. Determinado ello se establecerán sus implicancias; para luego hacer lo propio con respecto a la temática planteada en el título que ciñe la temática de este ensayo.

The aim of this paper is to analyse different perspectives which attempt todevelop the proper approach in relation to the object of property rights. It restricts its focus to the treatment of a sensitive issue, that of the rights of human embryos.In this study, we attempt to determine if the human embryo may or may not be the object of property rights. With this objective, this paper analyses the significance, as well as the social, ethical, legal and moral implications of the rights of the human embryo.Finally this paper considers the implications of affording property rights to the human embryo as the title and theme of the study suggest.
